Engaging us for investigative services

Stirling Investigations is a licensed private investigation firm. Before any investigative work begins, every client receives and signs a full Service Engagement Agreement covering pricing, scope, payment, cancellation, and a formal authorisation to act on the client's behalf. The summary below is provided for transparency; it is not the contract itself.

Current rates (excluding GST)

Payment terms

• A deposit of $800 + GST per booked day is payable before work begins. Jobs estimated above $5,000 require 75% of the estimated amount up front.
• Balance is payable 7 days after completion of the engagement.
• Final reports and footage are released only after the final invoice is paid.
• Interest of 10% per annum (calculated monthly) is charged on invoices overdue by more than 30 days.
• Cancellation within 24 hours of the scheduled start time attracts a $330 cancellation fee.

Outcome

Surveillance and investigation outcomes are not guaranteed. Clients agree to pay for the work conducted regardless of outcome. We will tell you honestly, on the first call, whether we believe we can usefully help with your matter.

Lawful conduct of investigations

All Stirling investigators operate under current state licensing and the relevant Australian privacy and surveillance legislation. In particular:

• We can only photograph or record activity that occurs in public places. We do not enter private property without authority and we do not record private conversations.
• We adhere to Australian road rules, which may at times limit our capacity to safely follow a subject who is driving recklessly or running lights.
• We will not place an investigator in a dangerous or unlawful situation.
• We will not undertake surveillance of any person against whom you hold or are subject to a restraining or apprehended-violence order. By engaging us, you confirm that no such order applies that would make our work unlawful.

Confidentiality

We treat the existence of every engagement, the identity of every client, and the details of every matter as strictly confidential. Information is disclosed only with client consent, where required by law, or where required by a regulator or court. Our handling of personal information is governed by our Privacy Policy.

Limitation of liability

To the extent permitted by law, our liability to you in connection with the website or our services is limited to the amount paid by you for the relevant engagement. We are not liable for any indirect, consequential, or special losses, including loss of profit, loss of reputation, or loss of opportunity.

Nothing in these terms excludes or limits any rights you may have under the Australian Consumer Law that cannot lawfully be excluded.

Indemnity for client instructions

Where you instruct us to conduct an investigation, you confirm that your instructions are lawful and that you have the right to engage us for the matter described. You indemnify us against any third-party claim arising from instructions you have given that turn out to be misleading, unlawful, or in breach of an order to which you are subject.

Governing law

These terms are governed by the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales in connection with any dispute arising from these terms or your use of this website.

Changes to these terms

We may update these Terms & Conditions from time to time. Any updates will be posted on this page with a revised "last updated" date. Continued use of the website after a change constitutes acceptance of the updated terms.
